Term and Conditions

These Terms of Service (“Terms”) govern your access and use of Boost U Sports’ website, related products, and services (“Services”), owned and operated by Boost U Sports (“Boost U,” “we,” “us,” or “our”).

By accessing or using the Services, you (“Brand,” “Sponsor,” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Overview of Services

Boost U Sports connects athletes with brands for marketing partnerships, promotional collaborations, and affiliate commission opportunities.

2. Eligibility

You represent and warrant that:

You are 18 years of age or older;
You have authority to enter into this agreement on behalf of your business or organization;
You will provide accurate information;
Your use of Boost U will not violate any applicable laws or third-party rights.

3. Brand Responsibilities

You agree to pay any agreed upon commissions to Boost U and to athletes in a timely manner.
You are responsible for the accuracy and legality of any promotional offers, materials, or content you share through Boost U.
You agree to communicate professionally with athletes and Boost U representatives.

4. Content and Usage Rights

You grant Boost U a non-exclusive, royalty-free license to use your brand name, logo, and promotional content solely to promote your brand’s collaboration opportunities on Boost U platforms.
You retain all ownership rights to your brand materials.

5. Fees and Payments

Boost U will retain an agreed-upon commission percentage from any athlete transactions or sales facilitated through our Services.
You are responsible for payment of all fees associated with any partnership agreements, discount programs, or affiliate sales programs established through Boost U.
Fees are due within 30 days of invoice unless otherwise specified in writing.

6. Limited License

Boost U grants you a limited, non-exclusive license to access and use the Services for your business’s promotional activities.
Unauthorized use, copying, or resale of Boost U Services is prohibited.

7. Termination

Boost U may suspend or terminate your access at any time for violation of these Terms.
You may terminate your participation by ceasing use of the Services, but you remain responsible for any outstanding payments.

8. Indemnification

You agree to defend, indemnify, and hold harmless Boost U Sports, its affiliates, and its partners from any claims, damages, liabilities, and expenses arising from:

Your use of the Services;
Your brand’s products, services, promotions, or content;
Your violation of any laws or third-party rights.

9. Limitation of Liability

Boost U Sports is not responsible for lost profits, indirect, or incidental damages.
Total liability to you shall not exceed $100 or the amount paid by you to Boost U Sports in the three months prior to the event giving rise to the claim.

10. Dispute Resolution

Disputes will first be attempted to be resolved through informal negotiation.
If unresolved, disputes under $10,000 will be settled via binding non-appearance-based arbitration.
Governing law: State of Arizona, with exclusive venue in Maricopa County.

11. Modifications

Boost U may modify these Terms at any time.
Updated Terms will be posted online. Continued use of Services after changes are posted constitutes acceptance of the new Terms.

12. Electronic Communications

You consent to receive notices and communications electronically via email or posting on the Boost U website.
